15. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless Elements of Green, its subsidiaries, licensors and affiliated companies, and their officers, directors, employees, contractors and agents from and against any and all claims, causes of action, damages, obligations, losses, liabilities, costs or debt, and expenses, including reasonable attorneys’ fees and costs, and all amounts paid in settlement resulting from any third party claim, action, or demand resulting from your use of the Site or your breach of these Terms and Conditions. You also agree to indemnify us for any loss, damages, or costs, including reasonable attorneys’ fees, resulting from your use of software robots, spiders, crawlers, or similar data gathering and extraction tools, or any other action you take that imposes an unreasonable burden or load on our infrastructure.
16. Disputes Resolution
DISPUTE RESOLUTION BY BINDING ARBITRATION
PLEASE READ CAREFULLY. IT AFFECTS YOUR RIGHTS.
Any dispute, controversy or claim arising out of or relating to any aspects of the relationship between you and Elements of Green, shall be submitted to arbitration administered by the Israeli Bar Association in accordance to its then existing Arbitration Rules under the Israeli Law. This arbitration agreement includes, but is not limited to, disputes, controversies or claims:
- based in contract, including, but not limited to, its existence, validity, breach, enforcement, interpretation or termination, and
- based in tort, statute, or any other legal theory.
Arbitration is more informal than a lawsuit in court. It uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award.
By agreeing to arbitration, the parties understand and agree that they are waiving their rights to maintain other available resolution processes, such as a court action or administrative proceeding, to settle their disputes.
The number of arbitrators shall be one. The arbitrator shall have the power to rule on his or her own jurisdiction, including, but not limited to, any objections with respect to the existence, scope, or validity of the arbitration agreement or to the validity of any claim or counterclaim.
Any claim shall be brought only in the party’s individual capacity, and shall not in any case be brought by the party as a plaintiff or class member in any purported class or representative proceeding.
The arbitrator’s award shall be binding on all parties, and judgment upon the award may be entered by any court of competent jurisdiction.
A party who intends to seek arbitration must first send to the other, by certified mail, a written Notice of Dispute (“Notice”). The Notice must (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought (“Demand”). If an agreement to resolve the claim is not reached within 30 days after the Notice is received, any party may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by a party shall not be disclosed to the arbitrator until after the arbitrator determines the amount, if any, to which a party is entitled.
17. Governing Law
These Terms and Conditions shall be governed, construed, and enforced in accordance with the laws of the State of Israel, without regard to its conflict of laws rules.
18. Consent to Receive Notices Electronically by Posting on the Site and Via Email
You consent to receive any agreements, notices, disclosures and other communications (collectively, “Notices”) to which these Terms and Conditions refer from us electronically including without limitation by e-mail or by posting notices on this Site. You agree that all Notices that we provide to you electronically satisfy any legal requirement that such communications be in writing. In particular, Elements of Green may immediately terminate or suspend accounts that have been flagged for repeat copyright infringement. Upon termination of your access to or ability to use the Site, your right to use or access the Site will immediately cease. These Terms and Conditions shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, and limitations of liability. Termination of your access to and use of the Site shall not relieve you of any obligations arising or accruing prior to termination or limit any liability that you otherwise may have to Elements of Green or any third party.
Payment
Payments for any purchases on the site shall be made by credit card, or PayPal.
Returns
If you bought an item on the site and want to make, use our portal Returns to create a request made and download necessitated the label to proceed. You can also contact us at: hello@eog1.wpenginepowered.com
Print the documents. Printouts shall be included within the package returned.
When you return an item we will ask you if it is still in its original packaging and it is not damaged, washed, used, or with the labels removed. Any item that does not meet these criteria cannot be refunded.
Make sure that the items returned are packed in a SINGLE pack.
We suggest sending the parcel with a service that provides traceability to monitor the items returned.
